Terms & Conditions

Last updated: October 6, 2026

1. About these terms

This website, www.brookecarrollreese.com, is operated by Brooke Carroll Reese, an independent art advisor trading as a sole trader ("I", "me", "my"). You can contact me at info@brookecarrollreese.com. These terms govern your use of this website. By using it, you agree to them. If you do not agree, please do not use the website.

Advisory services are provided under a separate written engagement agreement. If anything in that agreement conflicts with these terms, the engagement agreement applies.

2. Changes to my business

My advisory business may in the future be operated through a limited liability company. If that happens, I will update these terms and my policies, and references to "I", "me" and "my" will include that company.

3. Using this website

You may use this website for lawful, personal purposes. You must not misuse it, including by introducing viruses or harmful code, attempting to gain unauthorized access, scraping or harvesting content or data, or using it in any way that breaks the law or infringes anyone's rights.

4. Intellectual property

The text, design, logos and original content on this website belong to me or my licensors. Images of artworks remain the copyright of the artists, their estates or the relevant rights holders and are shown for identification and commentary. You may view and print pages for personal, non-commercial use and quote short extracts with a credit and a link back. You may not otherwise copy, reproduce, republish or commercially exploit any content without my written permission.

5. Professional disclaimer

My services include collection advice and acquisition support, guidance for those who have inherited art, introductions to appraisers and other specialists, commentary on art as an asset class (including art investment and art-secured lending), and editorial writing such as Art in Confidence. Content on this website, in my newsletter and on my social media is general information and education, not personalized advice. I only give advice to clients under a written engagement agreement, and that advice is limited to the scope set out in it.

Not financial, investment or lending advice. I am not authorized or regulated by the UK Financial Conduct Authority, and I am not a registered investment adviser, broker-dealer, lender or credit broker in the United States, the UK, the EU or any other jurisdiction. Anything I say about art as an investment, art-secured lending or financing, or art market performance is commentary on the art market. It is not regulated financial, investment, credit or tax advice, and it is not an offer or solicitation to buy or sell any security or financial product. Art is illiquid, its value can fall as well as rise, past performance is not a guide to future results, and you may get back less than you pay. Please take advice from a suitably authorized financial advisor before making any investment, borrowing or lending decision.

Not legal, tax or accounting advice. Estates and probate, inheritance and estate taxes, capital gains, import and export licensing, cultural property law, insurance and legal title all require specialist advice. I can help you understand where these issues arise, but you should consult a qualified lawyer, accountant or tax advisor before acting.

Valuations, attribution and authenticity. Unless I confirm otherwise in writing, I am not acting as a certified appraiser. Any view I share on value, condition, attribution or provenance is an opinion given in good faith on the information available at the time. It is not a formal appraisal and not a guarantee of authenticity, title, condition or future value. For insurance, probate, tax, charitable donation or sale purposes, please obtain a formal valuation from a qualified, independent appraiser.

Referrals and third parties. I may introduce you to auction houses, dealers, galleries, appraisers, conservators, art lenders, insurers, shippers, lawyers and other professionals. They are independent of me and responsible for their own services, advice and fees. Please carry out your own due diligence. If I receive any fee, commission or other benefit from a third party in connection with an introduction or transaction, I will tell you in writing before you proceed.

Conflicts of interest. I act in my clients' interests and will disclose any conflict of interest I am aware of. If a conflict cannot be managed fairly, I will decline or end the engagement.

No guarantee of outcome. The art market is unpredictable. I cannot guarantee the result of any purchase, sale, auction, loan, consignment or negotiation.

6. Consultations, bookings and payments

Consultations or services booked through this website are subject to the fees, scope and cancellation terms shown at the time of booking and in your engagement agreement. Payments are handled by third-party payment providers; I do not see or store your full card details. If you are a consumer in the UK or EU, you may have a right to cancel within 14 days of booking. If you ask me to begin work within that period, you agree to pay for work done before you cancel.

7. Inquiries and newsletter

Submitting an inquiry does not create a client relationship. Please do not send confidential or time-sensitive information until we have agreed to work together. You can unsubscribe from my newsletter at any time using the link in every email.

8. Third-party links

This website may link to third-party websites. I do not control them and am not responsible for their content, availability or privacy practices.

9. Availability and accuracy

I aim to keep this website accurate and available, but I do not guarantee that it will be uninterrupted, error-free or up to date. Market information and prices can change quickly.

10. Limitation of liability

To the fullest extent permitted by law, I am not liable for any loss arising from reliance on the general content of this website or my publications, or for any indirect or consequential loss, or any loss of profit, revenue, data or opportunity, arising from your use of this website. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded or limited by law, and nothing affects your statutory rights as a consumer.

11. Changes to these terms

I may update these terms from time to time. The version published on this page applies when you use the website.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere, you keep the protection of any mandatory laws of your country or state of residence and may bring proceedings in your local courts.
